First Amendment Takes A Big Hit - Material Support For Terrorism Law Upheld

Yesterday was a bad day for the First Amendment. The Roberts Court ruled in a 6-3 decision that the material support law was, under the strict scrutiny test, constitutional. At issue was whether human rights groups can provide educational services to groups designated as terrorist without being in legal danger themselves. The High Court found that there was sufficient State interest in this area to limit free speech protections and limit them severely.

The Center For Constitutional Rights (CCR) were part of the legal team that brought the suit. They argued that the definitions of “material support” were overly broad and vague. Some of the words at issue were “expert advice”, “training”, “service” and personnel”. These words can cover a lot of situations that have nothing to do with terrorism and everything to do with bringing terrorist groups into the political process and ending their terrorist activities.

On The Protection Of Hateful Speech -Westboro Baptist Church

A couple of days ago someone pointed out that I had two differing views on a topic in the same post. It came from my need to give some credence to the ideas that disagree with mine, but it is not the only time I find myself in conflict with myself. Take the situation with the incredibly vile and to my mind utterly worthless members of Westboro Baptist Church. These are the malignant and maleficent idiots that protest at military funerals with signs that say such warm and fluffy things as “Semper Fi Fags” and “God Hates You”. They are protesting what they see as the over acceptance of homosexuality in America. They believe that God is punished the United States with 9/11 for our tolerance of our gay citizens.

New Heroine Sparks Movement

Harry Hanbury has a story that any videographer or blogger would love. He created a video of Congresswoman Donna Edwards taking steps to amend the Constitution to restore our democracy following assault by the Supreme Court. A woman you've never heard of named Jessica Sharp saw the video and decided to take action herself. She had never organized a rally or even attended many, but she put together an event at the state capitol of Maryland that inspired every interested activist group and state legislator to join in. Jessica has sparked a movement in Maryland that is inspiring others around the country. So, Harry made a new video, about Jessica:

While the tea party movement and the coffee party movement are impressively mean and nice, respectively, the movement to restore human rights to human beings and dethrone the corporate rulers of our land is, in this collection of new movements led by new heroines, uniquely substantive.  It has a goal and concrete steps needed to reach it.

Of course, this means that we won't be able to claim success simply by holding rallies or getting on TV or becoming a factor in an election cycle.  To succeed we will actually have to change the country.  But we can do so one step at a time, and the tools we need have been made available at Free Speech for People.

We Were Arrested for Speaking

Me: Is that me?
USPP: Whoever. I'm flexible. I'm agreeable. I'm just here to please.
Me: Except for the whole arresting us part, huh? [climbing out of a cramped metal van where I'd been stuck with a dozen other men, our hands cuffed behind our backs so tightly they left marks and my friend's hands went numb]
USPP: What? I thought that was the whole point. You wanted to get arrested.
Me: No, we didn't want to get arrested. We wanted to engage in free speech.
USPP: Oh, I'm not going to get into that. Step over here. [He asks me my name and address.] Charlottesville? It's beautiful down there. Why would you want to come here and do this? [cutting himself off quickly] I mean I know why, you don't need to tell me.

But of course I did need to tell him. He just didn't want to know.

A Vermont Victory For Free Speech & Civil Disobediance

Victory!

In June, 2006, Boots Wardinski and Michael Colby had been arrested for disorderly conduct (it was really civil disobedience) in interrupting a speech given by warmonger John Negroponte at his son's graduation from St Johnsbury Academy (VT).

I met Boots and Michael back in late winter, 2007, when we participated in a sit-in at each of our Vermont congressional delegation's (Leahy, Sanders & Welch) offices in Burlington.

Yesterday Michael emailed me to say that in the case State vs. Colby and Boots Wardinski, the Vermont Supreme Court dismissed the charges. The court says the activists were acting within their free speech rights. Michael was ecstatic in his email, "Look out world, our record is clean..."

For now. Michael and Boots take their activism seriously.
